Reliance on credit ratings amount to a “governmentsanctioned oligopoly” for the dominant three rating agenciesMoody’s Corp (MCO.N), McGraw-Hill Cos Inc’s (MHP.N) Standard &Poor’s and Fimalac SA’s (LBCP.PA) Fitch Ratings, CommissionerKathleen Casey said. The SEC is considering the role of the credit ratingagencies and whether fund boards should designate certainrating agencies to evaluate and monitor its securities — anidea that highlighted deep divisions among SEC commissioners. Overall, the new rules would boost the funds’ liquidity andhelp ensure investors can get their money out of a fund, ifthey choose. The agency avoided taking a stance on a controversial ideato consider a fluctuating net asset value instead of thecurrent $1 NAV, or the level the fund needs to maintain inorder to pay back its customers if they want to redeem theirshares Instead the SEC seeks comments on whether this isneeded. Currently most funds are allowed to hold up to 5percent of such assets. SEC Commissioner Troy Paredes had some reservations andquestioned how this might hurt the ability of companies toraise capital. The SEC also proposed to prohibit the funds from investingin so-called second tier securities, or the second highestcategory of rated assets. Institutional funds, which experienced greater liquiditychallenges, would have to hold at least 10 percent of theirassets in liquid securities.

Retail money market funds would have to holdat least 5 percent of their assets in cash, U.S Treasurysecurities or other cash equivalents. The SEC proposed to shorten the average maturity ofdebt that money market funds can hold to 60 days from thecurrent 90 days. “Until last fall, few investors had concerns aboutinvesting in money market funds,” said Andrew Donohue, theSEC’s investment management director. The Securities and Exchange Commission unanimously votedfor a proposal that prohibits money market funds from buyingilliquid securities and requiring them to hold at least 5percent in liquid securities such as cash.
